Certification costs money, and the cost question comes up in every charger procurement: why pay for certified equipment when an uncertified unit with the same power rating costs less? It is a fair question. The answer is that certification is priced into the equipment, but the cost of skipping it shows up later, in places that do not appear on the price comparison: permits, insurance, funding compliance, and liability. This article lays out where those costs land, with the cost categories and decision checkpoints that procurement teams can take into a budget review.
The Permit Wall
In most US and Canadian jurisdictions, an EV charging installation goes through the authority having jurisdiction — the building or electrical inspector — before it goes live. The AHJ does not test the charger; it checks whether the equipment is listed or certified for the application. The reference is usually the National Electrical Code, which requires listed equipment for EV supply equipment installations. When the equipment is not listed, the inspector has no basis to approve it.
The result is not a debate. It is a stop-work situation: the charger is installed, the inspection fails, and the equipment has to be either removed or replaced while the site stands half-finished. Contractors who have been through it describe the same pattern: a failed inspection on a small commercial site costs days of crew time, extra labor to swap the unit, and — on a DC install — a lift rental to move the cabinet. On a single Level 2 install that can wipe out the entire price difference between certified and uncertified equipment, before the project even runs.
Insurance Takes the Long View
Insurers price risk from loss data, and the loss data on uncertified electrical equipment is not friendly. Commercial property and liability policies increasingly exclude or surcharge equipment that does not carry a recognized certification, and some carriers now ask directly whether EV supply equipment on site is UL or ETL listed. The scenarios that keep underwriters interested:
- A charger fire or failure damages the vehicle and the building. Without a certification trail, the carrier's investigation lands on the equipment, and the claim can be denied or subrogated against the site owner and the installer.
- An injury claim — electric shock, a cable trip hazard that becomes a liability matter — goes the same way. The absence of a listed product makes the site owner the party that should have known better.
- Business interruption at a site that exists to charge vehicles. If the chargers are down, the revenue is down, and the equipment's certification status is part of how fast the claim resolves.
Contractors carry their own exposure. An installation of uncertified equipment that fails later can come back on the installer's professional liability, regardless of what the purchase order said. The certification question is asked once at procurement and answered many times later, by lawyers and adjusters.
Funding Programs Write Certification Into the Rules
Public money moves the market. The NEVI program, the largest federal charging program in the US, funds DC fast charging along designated alternative fuel corridors, and its program guidance has been explicit about equipment requirements: certified equipment is written into the program requirements, alongside the Buy America provisions on manufacturing content. The two conditions are separate and audited independently — a project can satisfy the domestic-content requirement and still fail on certification. Utility incentive programs and municipal RFPs commonly carry the same condition: listed equipment, current certification, verifiable certificate numbers.
The compliance check is not a formality. Program-funded projects are audited, and the audit trail includes the equipment's certification documents. A project that passes its technical review but fails on certification documentation can lose its funding allocation or be required to replace equipment to stay compliant. The cost of that is the project's entire margin, and then some.
What Goes Into the RFP
The cheapest way to manage certification risk is to write it into the RFP as a scored criterion, so it is priced and evaluated before any equipment is selected. A workable clause:
- Each quoted model must carry current end-product certification to the applicable standard — UL 2202 for DC equipment, UL 2594 for AC equipment — or the equivalent ETL Listing.
- Certificate numbers must be provided with the bid, and the models on the certificate must match the models quoted.
- Certification records must be verifiable in the public directory (UL Product iQ or the Intertek directory).
- Bidder must provide certificate PDFs with the bid, not after award.
- If certification is pending at bid time, the bidder must state the lab, the submittal date, and the expected completion date, and the award must be conditional on completed certification.
- If the quoted configuration includes options (cable length, RFID, network modules), the bidder must confirm per SKU that the certified configuration covers it.
A scoring matrix can weight certification at 10–15 percent — a common range in infrastructure RFPs — because it is an objective, verifiable criterion that every bidder can meet or fail cleanly.
Who Carries the Liability
The liability chain for an uncertified installation has more links than most buyers expect. The site owner holds the operational risk — the asset, the visitors, the insurance policy. The general contractor or electrical contractor holds the installation risk — their work, their professional liability, and in some states a statutory obligation to install listed equipment. The operator, if the site is run by a charging network or a facilities management company, holds the ongoing exposure and answers to the insurer first when something fails. The equipment supplier sits at the end of the chain, and a supplier with no certification record has little to offer when the investigation starts.
The practical consequence: in a multi-stakeholder project, the equipment's certification status is not the manufacturer's concern or the buyer's concern — it is every party's concern, because any of them can be named in the claim. This is why commercial contracts for charging projects increasingly flow the certification requirement down from the owner to the contractor to the equipment spec, with each party warranting that the equipment they supply or install is listed or certified for the application.
The Cost Comparison That Actually Matters

The pattern repeats across the industry: the equipment price difference is real but small, and every downstream cost — inspection failures, insurance exclusions, funding audits, liability claims — is larger than the price difference, and nobody can tell you in advance which one will hit.

The verification side is quick. UL Listings check in the UL Product iQ directory. ETL Listings check in the Intertek directory. Certificate PDFs go in the project file. Certification is not a premium you pay for the privilege of buying from a cautious manufacturer. It is the mechanism that keeps permits, insurance, funding, and liability from becoming project-level problems. Procurement teams that treat it as a scored criterion in the RFP tend to find that the certified bidder's price and the uncertified bidder's price are close — and that the uncertified bidder's total cost of ownership only shows up after award, in the form of inspections, premiums, and audits that were never in the comparison.
